Terms of Use

Applicability:

This document, constituting the User Agreement, governs the terms and conditions for utilizing the services and products of Phil Technologies (P) Limited and its subsidiaries/affiliates ("Radium Box"). Both the User and Radium Box are collectively referred to as the "Parties" and individually as a "Party" to this User Agreement. The "Terms of Service" available on Radium Box's website detail the specific terms and conditions applicable to various services or products facilitated by Radium Box.

Eligibility to Use:

• The User must have the legal authority to enter into an agreement to become a User and utilize Radium Box's services.

• By accessing the Website, engaging with any Sales Channels, or procuring services from Radium Box, Users are deemed to have read, understood, and accepted this User Agreement. If the User disagrees with any part of this Agreement, they must refrain from using Radium Box's services or accessing its Sales Channels.

• All rights and responsibilities concerning services or products facilitated by Radium Box are limited to the provisions of this User Agreement.

Content:

• All content provided through Radium Box's Sales Channels, including audio, images, software, text, icons, and similar materials ("Content"), are owned by Radium Box and protected under applicable intellectual property laws. Users may only use this Content as specified within this User Agreement.

• Users agree to adhere to all instructions provided by Radium Box regarding the usage of Content.

• Proprietary logos, service marks, and trademarks displayed on Radium Box's website and other Sales Channels are owned by Radium Box and cannot be utilized by Users without explicit permission.

• Radium Box respects the intellectual property rights of others. Users are encouraged to report any instances of infringement to Radium Box, including clear identification of copyrighted works, the location of the infringing material, proof of ownership, and contact information.

Website:

• The Website is intended for lawful use by bona fide Users.

• Users are prohibited from distributing, modifying, selling, or transmitting any content from the Website for commercial purposes without prior authorization.

• Access to certain Website features may require User registration. Users must provide accurate information during registration and ensure the confidentiality of their account credentials.

• Radium Box reserves the right to terminate access to the Website or any of its services at any time without notice for maintenance or other reasons.

• While Radium Box endeavors to maintain a secure Website, Users acknowledge that downloading data or information is done at their own risk, and Radium Box is not liable for any damages resulting from such actions.

• Radium Box may periodically update or change its Website content without prior notice. Users are encouraged to report any unlawful or objectionable content for investigation and appropriate action.

Security and Account Related Information:

• It is the responsibility of users to keep their account credentials private and to alert Radium Box of any illegal account access.

• Radium Box secures user data in compliance with applicable laws but cannot guarantee immunity to security breaches. User data may be shared with law enforcement agencies for lawful purposes.

Fees and Payment:

• Radium Box may charge fees in addition to product costs and reserves the right to modify fees as necessary. Users are responsible for all charges, taxes, and fees associated with product or service usage.

• In cases of undercharging, Radium Box may deduct the balance amount or cancel the product if payment is not completed before delivery.

• Users must make payments only to Radium Box's designated bank accounts to avoid unauthorized transactions.

• Sensitive information should not be shared with anyone, including Radium Box's representatives, and Users must report any such requests to Radium Box.

• Refunds for cancellations will be processed to the original payment method.

Usage of User Communication Details:

• Radium Box may use communication channels provided by the User for transaction-related communications in compliance with local laws and regulations.

• Users can withdraw consent for receiving messages or emails by contacting Radium Box or adjusting notification settings.

• Radium Box is indemnified against losses resulting from erroneous complaints or incorrect contact details provided by Users.

Force Act:

• In exceptional circumstances, Radium Box may be unable to fulfill product obligations due to Force Act events. Users should contact the Service Provider for resolutions.

• Radium Box is not liable for damages resulting from Website or Sales Channel usage.

Advertisers and Linked Websites:

• Radium Box is not responsible for third-party website content or representations.

• Users should verify information provided by advertisers or on linked websites.

• Linked sites are not under Radium Box's control, and Radium Box is not liable for their content or changes.

• Right to Refuse:

• Radium Box reserves the right to refuse service without providing a reason.

• User registration may be suspended or terminated if the User breaches this User Agreement or if Radium Box cannot verify User information.

• Users must not engage in prohibited activities or communications as outlined in this Agreement.

Right to Cancel:

• Users must provide accurate information to Radium Box, and Radium Box reserves the right to cancel products in case of unauthorized or incorrect information.

• Users must not hold Radium Box responsible for cancellations due to suspected fraud.

Fake Calls and Fraudulent Activities:

• Radium Box does not solicit sensitive information or fund transfers from Users, and Users should report any such requests to Radium Box.

• Indemnification:

• Users must indemnify Radium Box against losses arising from breach of representation, warranty, or non-performance of covenants.

• Users are solely liable for breaches of specific rules or regulations.

Miscellaneous:

• If any provision of this User Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• Radium Box reserves the right to amend this User Agreement, and Users are responsible for reviewing updates.

• Confidential information specified by Radium Box must be maintained as such by Users.

• Users authorize Radium Box to contact them for feedback and have the right to address complaints to the designated Grievance Officer.

• Users must adhere to Radium Box's Privacy Policy available on its website. Continued use of the Website constitutes acceptance of the Privacy policy.

Information We Collect:

We do not collect private information of those viewing the Radiumbox. Personal information is not automatically recognized by our servers. We do not use cookies to store your personal information. If we decide to implement cookies, it will be to store visitor preferences and record session information in order to provide faster, better, more personalized service when you return to our Radiumbox. The same shall be added to the privacy policy. The email addresses of those who communicate with us via the query box and any information volunteered by our viewers may be stored in order to contact our viewers regarding queries they may have put forth. We do not share your information with any other commercial business. Neither is such information used for any other purpose other than that mentioned herein. We do not partner with or have special relationships with any ad server companies.
