Applicability:
This User Agreement is a legal binding document between the user and Phil Technologies (P) Limited. Its subsidiaries/ affiliates (hereinafter referred to as "Radium Box") describing the terms and conditions under which the offered services and products can be used. This user agreement may apply to all products and services sold by Radium Box through its official website. Our Support Team, Offices, Sales Executive or agents will govern the use of these products and services by the individual ('User') agrees to follow by this User Agreement.
Both the User and Radium Box are jointly referred as the "Parties" and individually as a "Party" to this User Agreement. The Website will have "Terms of Service" specifying certain terms and conditions for using the website or various services/products facilitated by Radium Box.
Eligibility to Use:
The User must have legal authority to enter into a contract with Radium Box and use the service of Radium Box available on its website.
By accessing the Website, engaging in any of Sales Channels, or procuring services from Radium Box, users of Radium Box will consider to have read, understood, and accepted this User Agreement.
If a User does not agree with any provisions of this Agreement, he/she should refrain from using the services of, or accessing, the Sales Channels of Radium Box.
All rights and obligations with respect to services or products sold, assisted, or otherwise facilitated by Radium Box, are governed by the terms of this User Agreement.
Content:
All Content available through the Sales Channels of Radium Box, including without limitation audio, images, software, text, icons, and any materials of a similar nature, is proprietary to Radium Box and is also subject to the applicable intellectual property laws. The use by Users of such Content shall be only as provided for in this User Agreement.
Users shall follow all the directions and instructions that are issued by Radium Box concerning the use of Content.
All service marks, proprietary logos, and trademarks that are displayed on the Radium Box website and any/all other Sales Channels belong to Radium Box, and no use of these shall be made without express prior written permission.
Radium Box respects the intellectual property rights of others. Users are encouraged to report any instances of infringement to Radium Box, including clear identification of copyrighted works, the location of the infringing material, proof of ownership, and contact information.
Website:
The Website is intended for lawful use by genuine Users.
Users are prohibited from distributing, modifying, selling, or transmitting any content from the Website for commercial purposes without prior authorization.
The Website may require the User to register to use certain features. During registration, the Users shall provide valid information and shall keep their account credentials confidential.
Radium Box reserves the right to terminate any Website or its service at any time without notice for maintenance or any other reason.
While Radium Box tries to keep a secure Website, Users agree that all downloads of data and information are at their own risk, and Radium Box is not responsible for any damage whatsoever to the User's computer system or loss of data that result from the download of any such data or information.
Radium Box reserves the right to update or change its Website content at any time without notice. Users are also requested to inform about any illegal or unwarranted content so that appropriate action may be taken.
Security and Account Related Information:
Users must maintain the confidentiality of their login details and must inform Radium Box if there is any unauthorized access to their account.
Radium Box will use all efforts to keep the user's information confidential as per the applicable laws but does not guarantee protection from hacking. The User Data may also be shared with law enforcement agencies upon their legitimate request.
Fees and Payment:
Radium Box may at any time charge fees in addition to the product cost and may change the fee from time to time as and when necessary. The user shall be responsible to pay for all charges, taxes, and fees that will be charged on any product or services availed from the website.
If due to any error or deletion the product is undercharged, Radium Box reserves the right to deduct the balance amount or cancel the product if payment is not made in full before dispatch or delivery of the product.
The user shall make payment only in the bank account of Radium Box to avoid unauthorized transactions.
That sensitive information shall not be shared with any person, including any representative of Radium Box and The User shall inform the Radium Box about any such demand.
The refunds on cancellations will be processed to the same source initial payment method.
Using the user details of communication:
Radium Box may use the communication channels provided by the user for transaction-related communication strictly under the compliance of local laws and regulations.
In the case that Users wish to withdraw the consent for receiving messages or emails, they are to contact Radium Box or change the notification settings.
Radium Box is reimbursed against losses arising from erroneous complaints or wrong contact details furnished by the Users.
Force Act:
In extraordinary circumstances, Radium Box may not be able to serve the products due to a situation of Force Act. In such cases, Users must reach out to the Service Provider with regard to the resolutions.
Radium Box is not liable for any damages whether due to Website or Sales Channel usage.
Advertisements and Linked Websites:
Radium Box has no liability for representations or the content of any third-party websites.
The User is responsible for checking that the information supplied by advertisers or linked website content is accurate and complete.
The linked sites are not under the control of Radium Box and Radium Box is not responsible for their content or changes.
Right of Refusal:
Radium Box reserves the right to refuse its service without reason.
The User registration may be suspended or terminated if the User violates this User Agreement or if Radium Box is unable to verify User information.
Users shall not carry out prohibited activities or communications including but not limited to, under this Agreement.
Right to Cancel:
Users shall provide accurate information to Radium Box, and Radium Box retains the right to cancel products in case of unauthorized or incorrect information.
Users shall not hold Radium Box liable for cancellations on account of suspected fraud.
Fake Calls and Fraudulent Activities:
Radium Box does not ask for sensitive information or fund transfers from Users, and the User should report such requests to Radium Box.
Indemnification:
The Users shall indemnify Radium Box against losses arising out of break of representation, warranty, or non-performance of contracts.
Users shall solely be liable for break through of any specific rules or regulations.
Miscellaneous:
If any provision under this User Agreement is held to be invalid or unenforceable, such provision shall be ineffective only to the extent of such invalidity or unenforceability, without affecting in any way the remaining provisions hereof.
Radium Box reserves the right to modify this User Agreement at any time, and it is the responsibility of Users to periodically review changes in the Agreement.
Confidential information identified by Radium Box shall be treated as confidential by Users.
Users consent to Radium Box getting in touch with them for bringing out their feedback and users are free to address their grievances to the Grievance Officer.
Users are requested to make themselves familiar with the Radium Box's Privacy Policy is updated on its website. The continued use of the Website shall be presumed to be the acceptance of the Privacy policy.
Information We Collect:
We do not collect the private information of the viewers of Radium box. The personal information is also not automatically identified by our servers. We do not use cookies to store your personal information. In case we decide to implement cookies, it shall be for storing visitors' preferences and record session information to provide a faster, better, more personalized service when you return to our Radiumbox. The same shall be added to the privacy policy. The email addresses of people who communicate with us via the query box and any information volunteered by our viewers may be kept to contact our viewers about questions they may have posed. The information you provide will not be shared with any other commercial business. Neither is such information used for any other purpose other than that mentioned herein. We do not partner with or have special relationships with any ad server companies.
